Creamy Layer aur SC/ST Reservation ka Complete Safar

Chai pe kahani style mein — 1947 ke Constituent Assembly se leke is hafte ke affidavit tak, reservation policy ka poora constitutional safar. Ek hi sawaal ke peeche chalte hue: agar backwardness ki cream ko OBC mein exclude kiya ja sakta hai, toh SC/ST mein kyun nahi — aur Constitution ne dono ko alag kyun rakha tha. Kal hi Centre ne Supreme Court ko apna jawab de diya hai.

Scene 1: 1947 — Framers ke Saamne Teen Alag Problems

Aazadi ke baad Constituent Assembly ke saamne teen distinct groups the:

SCs — Sadiyon se untouchability jhel rahe. Mandir entry nahi, paani nahi, alag baithna. Ye caste-based discrimination tha, primarily Hindu social hierarchy mein.

STs — Jungle-pahaadon mein isolated, mainstream se disconnected. Distinct culture, language, customs. Inka issue social nahi, geographical + cultural isolation ka tha — land alienation, forest displacement.

OBCs — Hindu hierarchy mein middle mein (Shudras, artisan castes, peasant castes). Untouchable nahi, but socially aur educationally backward.

Framers ne socha — "Formal equality" (kaagaz pe barabar) enough nahi, "substantive equality" chahiye. Race mein jo 100 meter peeche se shuru kare, uske liye special provision zaroori.

Scene 2: Constitutional Foundation aur SC/ST Identification Process

Fundamental Rights (Part III):

  • Article 14 — Equality before law
  • Article 15(1) — No discrimination on caste/religion/race/sex/place of birth
  • Article 15(4) — Special provisions for SC/ST/SEBC allowed
  • Article 16(1) — Equal opportunity in public employment
  • Article 16(4) — Reservation for backward classes in services

DPSP (Part IV):

  • Article 46 — State's duty to promote educational/economic interests of SC/ST and weaker sections

Identification Provisions:

  • Article 341 (SC) — President notifies SC list for each state/UT after Governor consultation. Only Parliament can modify — State kuch nahi kar sakti.
  • Article 342 (ST) — Same process for STs.
  • Article 335 — SC/ST claims in services
  • Article 340 — President can appoint commission to investigate backward classes ki condition

First lists: Constitution (Scheduled Castes) Order, 1950 aur Constitution (Scheduled Tribes) Order, 1950.

Lists state-specific hain — ek caste ek state mein SC ho sakti hai, doosre mein nahi. Benefits state-wise portable nahi hain.

Scene 3: SC/ST Criteria — Lokur Committee (1965)

SC criteria (Lokur Committee ke):

  1. Extreme social/educational/economic backwardness (from untouchability)
  2. Traditional untouchability practice

Religion restriction — yeh Lokur Committee ka criterion NAHI hai. Yeh Constitution (Scheduled Castes) Order, 1950 ke paragraph 3 mein baitha hai: shuru mein sirf Hindu, 1956 mein Sikh jode gaye, 1990 mein Buddhist. Christian/Muslim SC nahi ho sakte.

ST criteria (5 hallmarks):

  1. Primitive traits
  2. Distinctive culture
  3. Geographical isolation
  4. Shyness of contact
  5. Backwardness

No religion bar — Christians/Muslims ST ho sakte hain (North-East tribes).

Scene 4: SEBC Concept — OBC ka Constitutional Naam

Constitution mein "OBC" word hai hi nahi. Broader term hai — SEBC (Socially and Educationally Backward Classes).

  • Article 15(4) — SEBC ke liye special provisions
  • Article 16(4)"backward class of citizens" mention karta hai

Framers ne OBC list nahi banayi — Article 340 ke through Presidential commission ka mechanism diya.

Scene 5: 1951 — Champakam Dorairajan aur 1st Amendment

Madras mein caste-based medical college quota — Communal G.O. Champakam Dorairajan pehle Madras High Court gayi Article 226 ke tehat, aur jeet gayi; phir State of Madras ne Supreme Court mein appeal ki — isliye case ka naam State of Madras v. Champakam Dorairajan hai.

Court ne G.O. strike down ki — mukhya taur pe Article 29(2) ke violation ke liye (State-maintained institution mein caste/religion/race/language ke aadhaar pe admission se inkaar), Article 15(1) ke saath padhte hue. Aur ek badi baat tay hui: Fundamental Rights DPSP pe bhaari padte hain.

Prelims mein Champakam ka standard jawab Article 29(2) hai, sirf 15(1) nahi. 15(1) aur 46 discussion mein the; ratio 29(2) ka hai.

Reaction: Nehru government ne 1st Constitutional Amendment (1951) laaya. Article 15(4) insert hua — reservation ki constitutional foundation set. Ye pehla constitutional amendment tha.

Scene 6: 1953 — Kaka Kalelkar Commission (First BCC)

Article 340 ka pehla use. President ne First Backward Classes Commission appoint ki. Chairman — Kaka Kalelkar.

1955 Report:

  • 2,399 castes backward identified — jinme se 837 "most backward" classify hui
  • 4 criteria for backwardness — (i) traditional caste hierarchy mein low social position, (ii) caste/community ke bade hisse mein educational advancement ki kami, (iii) government service mein inadequate ya nil representation, (iv) trade, commerce aur industry mein inadequate representation
  • Reservation recommended

Kalelkar ke 4 criteria hain, 11 nahi. 11 indicators Mandal ke hain. Do commissions ke numbers aapas mein badal jaana yahan sabse common galti hai.

Twist: Khud Kaka Kalelkar ne forwarding letter mein disagreement likha — "Caste-based identification se casteism badhega." Report 1956 mein Parliament mein table hui, implement nahi hui.

Outcome: OBC reservation 25 saal latka.

Scene 7: Meanwhile — Central vs State List Concept

Central govt OBC nahi kar rahi thi, but states ne apni OBC lists banayi (Tamil Nadu, Karnataka, Kerala, Andhra). Yahan clear hua:

  • Central List — Central jobs + central institutions (IITs, AIIMS, central universities)
  • State List — State jobs + state institutions

Constitutional basis: Articles 15(4), 16(4) states ko bhi authorize karte hain. Dono lists alag operate karti hain.

Scene 8: 1979 — Mandal Commission (Second BCC)

Morarji Desai's Janata Government ne Article 340 dobara use kiya. Chairman — B.P. Mandal.

Methodology:

  • 1931 caste census used (last available)
  • Field surveys
  • 11 indicators (Mandal Criteria)4 social (3 points each = 12), 3 educational (2 points each = 6), 4 economic (1 point each = 4). Total 22 points; jo caste 11 points (50%) ya usse zyada score kare, wo SEBC list mein

1980 Report:

  • 3,743 castes OBC identified
  • 52% population OBC estimate
  • 27% reservation recommended (SC 15% + ST 7.5% + OBC 27% = 49.5%, staying under 50%)

Report thandi padi 10 saal. Indira Gandhi (1980 wapasi) ne implement nahi kiya, Rajiv Gandhi ne bhi nahi.
