Chai Pe Charcha: Supreme Court ne "Retrospective" Green Clearance ka Darwaza Band Kar Diya

2021 ka Office Memorandum quashed — Centre ab administrative order se ex post facto clearance nahi de sakti. Amnesty exception hoti hai, rule nahi; aur prospective quashing ne chaabi sirf Supreme Court ke paas rakhi.

Chai Uthaiye — Aaj Ki Baat Kya Hai

Chaliye aaj ek aisa judgment discuss karte hain jo environmental governance ka pura chessboard hila deta hai. Supreme Court ne 2021 ke ek Office Memorandum ko quash kar diya hai — aur iske saath ek badi baat keh di hai: Centre ab administrative order se ex post facto environmental clearance nahi de sakti.

Sunne mein legal-technical lagta hai, but iska matlab bahut simple hai — agar aapne pehle project shuru kar diya aur baad mein clearance liya, toh ab wo shortcut band ho gaya hai.

Baithiye, chai lijiye, main aapko poori kahani samjhata hoon — kyunki ye topic Prelims mein bhi aa sakta hai, Mains ke GS-2 aur GS-3 dono mein fit hota hai, aur Essay mein "development versus environment" ka evergreen theme hai.

Pehle Samjhiye — Ye Ex Post Facto Clearance ka Chakkar Kya Hai

Dekhiye, India mein Environment Impact Assessment (EIA) ka pura framework Environment (Protection) Act, 1986 ke Section 3 ke under banaya gaya hai. Iske base par EIA Notification, 2006 aayi, jo kehti hai — bhaiya, agar aap koi bada project laga rahe ho — highway, airport, mining, real estate, township, thermal plant — toh pehle environmental clearance (EC) lo, phir kaam shuru karo.

Prior EC regime. Word hi sab kuch keh deta hai — prior, yaani "pehle". Clearance kaam se pehle aani chahiye, baad mein nahi. Yeh timing hi poore framework ki jaan hai, kyunki EIA ka maksad hi yeh hai ki nuksaan hone se pehle uska andaza lagaya jaye.

Ab hota kya tha? Kai project proponents — kabhi private, kabhi khud state agencies — kaam shuru kar dete the bina clearance ke. Jab pakde jaate the, toh sarkar ke paas do raste the: ya toh project girao (jo practically impossible tha, kyunki hazaaron crore ki investment ho chuki hoti thi), ya kisi tarah "regularise" kar do.

Isi dilemma se nikla — ex post facto environmental clearance. Latin term hai; iska matlab hai "after the fact". Yaani pehle kaam ho gaya, baad mein clearance de diya.

Sarkar ne isko institutionalise karne ke liye do kadam uthaye:

  1. 2017 Notification — ek "one-time amnesty" scheme laayi.
  2. 2021 Office Memorandum (OM) — isko permanent bana diya. Matlab jo bhi project bina clearance ke chalu ho gaya hai, ya aage ho jayega, uske liye ek regular Standard Operating Procedure.

Yahin par court ko problem hui.

Court ka Reasoning — Kyun Quash Kiya

Bench ne bahut sundar tareeke se socha. Unke logic ke paanch pillars samajhte hain.

Ek — Administrative order se delegated legislation change nahi kar sakte

2006 notification ek delegated legislation hai — matlab Parliament ne EPA 1986 mein power di Centre ko, aur Centre ne wo power use karke yeh notification banayi. Iski legal sanctity hai.

Ab 2021 ka OM — jo sirf ek internal administrative instruction hai — usko override kaise kar sakta hai? Court ne kaha yeh "impermissible in law" hai. Hierarchy of law mein administrative order sabse neeche hota hai; wo statutory notification ko replace nahi kar sakta.

Do — Amnesty exception hoti hai, rule nahi

Court ne accept kiya ki kabhi-kabhi genuine cases mein — jaise koi hospital, koi drought relief project — retrospective clearance ki zaroorat pad sakti hai. Lekin amnesty ka matlab hai rare, finite, class-specific. 2021 OM ne isko perpetual bana diya — permanent, unlimited, sab industries ke liye khula. Yeh amnesty nahi, parallel route ban gaya.

Court ki line yaad rakhiye: "An amnesty measure cannot become a permanent, parallel route which circumvents the prior EC regime." Yeh ek hi vaakya mein poore judgment ka core hai — aur Mains answer mein quote karne layak hai.

Teen — Article 14 aur 21 ka violation

Court ne kaha ki 2021 OM mein koi intelligible differentia nahi tha — matlab koi rational basis nahi tha ki kaunse project ko clearance milega aur kaunse ko nahi. Sabko blanket permission. Yeh Article 14 (equality, non-arbitrariness) violate karta hai.

Aur clean environment Article 21 ka part hai — right to life. Isko bina proper enquiry ke compromise karna Article 21 ka bhi violation hai.

Chaar — "Pollute and pay" versus sustainable development

Yeh sabse important philosophical point hai. 2021 OM mein tha ki violator thodi si environmental compensation dega aur clearance mil jayega. Court ne kaha — yeh toh "pollute and then pay" ka principle ho gaya, jo hamare polluter pays principle ke bilkul ulta hai.

Do naam bahut milte-julte lagte hain, lekin ulte hain. Polluter pays kehta hai — jo pollution karega wo damage ka cost bharega, taaki pollution ruke. Pollute and pay kehta hai — pehle pollute karo, phir chhota sa fee do, sab maaf. Ek deterrent hai, doosra effectively ek licence. Exam mein yehi fark poocha jaata hai.

Paanch — Jan Vishwas Act, 2023 ne aur bigaad diya

Pehle EPA 1986 ke under prior EC violate karne par paanch saal tak jail ho sakti thi, ya ek lakh fine. 2023 mein Jan Vishwas (Amendment of Provisions) Act aaya — iska maksad tha "decriminalise minor offences to improve ease of doing business". Isne EPA ke is offence ko criminal se civil liability bana diya.

Court ka observation dhyaan se padhiye: "A lax implementation regime, coupled with a regularisation scheme unlimited in time and subject to capped environmental compensation at a flea-bite level, rendered the prior EC regime otiose both in fact and in law."

Yaani dono ne milkar prior EC ke regime ko practically bekaar bana diya tha.

Ek Interesting Twist — Prospective Quashing aur Article 142

Yahan par court ne practical wisdom dikhayi. Agar wo 2021 OM ko retrospectively quash karti, toh AIIMS Odisha, Tamil Nadu ka cancer hospital, Karnataka ka Vijayapura Airport, medical colleges, slum rehabilitation, irrigation projects — sab lafde mein aa jaate. Hazaaron crore ka public interest daanv par.

Toh court ne prospective quashing kiya — matlab aaj ke baad yeh OM lagoo nahi hoga, lekin jo clearance pehle mil chuki hai wo valid rahegi, jab tak koi alag se challenge na kare.

Aur ek aur important baat — court ne kaha ki wo khud, apni Article 142 (complete justice) powers ka use karke, case-by-case ex post facto clearance de sakti hai.

Darwaza band nahi kiya gaya — chaabi sirf Supreme Court ke paas rakh li gayi. Executive ab blanket regularisation nahi kar sakti; relief chahiye toh ya proper notification laao, ya court ke saamne aao.

Case ka Roller Coaster Journey

Yeh samajhna zaroori hai, kyunki interview mein poochha ja sakta hai.

  • May 2025 — SC ki ek Division Bench ne ex post facto clearances ko "gross illegality and anathema to the environment" keh diya. Cheeni ekdum band.
  • November 2025 — ek larger Bench ne isko dilute kar diya. Kaha ki agar retrospective clearance regime bilkul hata denge toh ongoing public projects worth "thousands of crores" par "devastating effect" padega. Practical concern samajh mein aata hai.
  • July 2026 — is judgment mein final position aayi. Balance banaya gaya: policy strike down, lekin ongoing projects protected, aur future ke liye clear rule — administrative order se yeh nahi ho sakta; chahiye toh proper notification laao.

GS-2 angle: governance aur judiciary

Delegated legislation versus administrative instructions. Yeh classic constitutional law question hai. Parliament ne EPA 1986 banayi. Uske under Centre ne 2006 notification jaari ki — yeh delegated legislation hai. Ab isko badalna hai toh ya Act amend karo, ya usi procedure se nayi notification laao. Sirf ek Office Memorandum se — jo internal administrative communication hai — statutory scheme badalna rule of law ke against hai. Court ne is boundary ko sharply define kiya.

Judicial review of executive action. Court ne executive ke policy space ko respect kiya (amnesty case-by-case abhi bhi possible hai), lekin arbitrary blanket regularisation ko strike down kiya. Yehi balance judicial review ka essence hai — court na policy-maker banti hai, na executive ko blank cheque deti hai.

GS-3 angle: environment aur development

Yahan classic tension hai — infrastructure growth versus ecological safeguards. Court ka message clear hai: shortcut se sustainable development nahi milta.

Regulatory capture aur moral hazard. Jab regulator khud "regularisation" ka safety valve provide karta hai, toh violators ko rule todne ka incentive mil jaata hai — kyunki wo jaante hain, "chalo tod dete hain, baad mein compensation dekar clearance mil jayegi." Yeh textbook moral hazard hai, aur court ne theek isi ko pakda.
