Broader Themes of the Tribal Question in India — Full Chai Pe Kahani

Dus themes, ek saath — constitutional protection se ground reality tak, displacement paradox se assimilation-autonomy debate tak, forest nexus se LWE tak, institutions se gender aur health tak, chhe dashak ke committee reports se digital exclusion tak. Har theme ke neeche ek hi sawaal hai: Indian state protective mode mein hai, assimilative mein, ya extractive mein? Aur asli transformation tab hoga jab tribal community principal bane aur state agent — na ki ulta.

Yeh Kahani Kis Ke Saath Padhni Hai

Bhaiya, ab ek-ek karke saari themes ko layer-by-layer kholte hain. Yeh sirf exam ke liye nahi — yeh understanding of India's tribal question hai jo aapko bureaucrat, thinker, policy person ke perspective se samajhna chahiye.

Theme 1: Constitutional Protection vs Ground Reality

Constitutional Architecture

Article 244 — Part X of Constitution — "Administration of Scheduled Areas and Tribal Areas"

  • 244(1) → Fifth Schedule → applies to states OTHER than Assam, Meghalaya, Tripura, Mizoram
  • 244(2) → Sixth Schedule → applies to Assam, Meghalaya, Tripura, Mizoram (NE tribal areas)

Fifth Schedule ka core mechanism:

  • President declares Scheduled Areas (currently 10 states)
  • Governor has special responsibility — reports annually to President
  • Tribes Advisory Council (TAC) — advises Governor
  • Governor can make regulations — including prohibiting land transfer to non-tribals

Sixth Schedule mechanism:

  • Autonomous District Councils (ADCs) — legislative, executive, judicial powers
  • Land, forest, customs, marriage — sab local council control karta hai
  • Much stronger than Fifth Schedule TAC

Ground Reality Kya Hai?

Ab yeh sab paper pe strong lagta hai. Lekin zameen pe kya ho raha hai?

Problem 1: Governor's role dormant hai. Fifth Schedule mein Governor ko lot of discretionary power hai — regulations bana sakte hain jo Parliament laws ko override kar sakti hain in Scheduled Areas. Lekin practically Governors state government ki advice pe chalte hain, aur state governments industry-mining lobby se pressure mein hoti hain. Xaxa Committee (2014) ne specifically kaha — "Governors have failed to exercise their special responsibility."

Problem 2: TAC advisory ban ke reh gayi. Tribes Advisory Council members mostly ruling party ke ho jaate hain. Real tribal voice suppressed. Meetings frequently nahi hoti. State kabhi TAC recommendations ko binding nahi maanta.

Problem 3: Scheduled Areas notification khud purani hai. Kayi areas jahan tribal population ab significant hai, waha declaration nahi hui. Kayi jagah tribal-non-tribal ratio badla hai but Scheduled Area status waisa hi hai.

Problem 4: PESA ke conformity rules banaye hi nahi. PESA 1996 ka Section 4 kehta hai — states 1 year ke andar apne panchayat laws ko PESA ke conformity mein laayenge. 2026 mein bhi kayi states ne rules nahi banaye — Jharkhand, Chhattisgarh, Odisha jaise states mein rules incomplete hain.

Problem 5: FRA implementation asymmetric. Individual Forest Rights — kuch progress hai. Community Forest Rights (CFR) — jahan asli power hai — waha implementation weakest hai. Because state forest department loose power karta hai CFR mein.

Problem 6: NCST toothless. NCST ke paas advisory role hai, coercive power nahi. Reports late aati hain, government respond nahi karti. Chairman/member vacancies chalti rehti hain. NCST ki adequacy ek recurring exam theme hai — aur uska honest jawab "nahi" hai.

Constitutional protection ka model tha "protective discrimination" — matlab tribals ko mainstream se protect karna, unki agency respect karna. Lekin implementation model "welfare delivery" ban gaya — matlab state top-down services deliver karega, tribal recipient banega.

Yeh fundamental shift hi problem hai. Protection = agency, but welfare delivery = dependency.

Adi Karmayogi Abhiyan, Adi Sewa Kendras — yeh bhi welfare delivery framework mein fit hote hain, protective autonomy mein nahi.

Theme 2: Development vs Displacement Paradox

"Growth ki keemat kaun chuka raha hai?"

Ek shocking data se shuru karte hain. Independence ke baad se ab tak India mein approximately 6-8 crore log displaced hue hain development projects se — dams, mines, industrial projects, wildlife sanctuaries. Inmein 40-50% tribals hain, jabki total population mein tribals sirf 8.6% hain.

Matlab, tribals population share se 5-6 guna zyada displacement face karte hain. Yeh statistical anomaly nahi hai — yeh structural pattern hai.

Kyun Structural Hai?

  • Land — sparsely populated, "acquisition cheap"

Overlap map dekho — India ke 80%+ mineral wealth tribal-dominated districts mein hai; Aspirational Districts ki significant % tribal districts hai; LWE-affected districts mein tribal + mineral overlap ka triple concentration hai.

Toh jab bhi "growth" hoti hai, "displacement" tribal ke haath aata hai.

Legal Architecture (Aur Uske Gaps)

Land Acquisition, Rehabilitation & Resettlement Act 2013 (LARR)

  • Section 41 — Scheduled Areas mein acquisition avoid karna hai jab tak "demonstrably last resort"
  • Gram Sabha ki prior consent mandatory in Scheduled Areas
  • 80% consent for private projects, 70% for PPP
  • Rehabilitation & Resettlement package

PESA 1996 — mandatory consultation before land acquisition in Scheduled Areas.

Forest Rights Act 2006 — Section 4(5) — no eviction till FRA process complete; Gram Sabha consent needed for forest diversion.

Samatha Judgment (1997) — Supreme Court — private mining leases in Scheduled Areas of Andhra Pradesh unconstitutional (though later partially diluted).

Niyamgiri Judgment (2013) — Supreme Court — Dongria Kondh Gram Sabhas can veto Vedanta's bauxite mining project. Historic precedent — but implementation weak elsewhere.

Lekin Ground Pe Kya Hota Hai?

Consent manufactured hoti hai. Gram Sabhas ki meeting hoti hai, but attendance, quorum, information — sab manipulate hote hain. Officials + contractors mil ke "consent" resolution paas kara lete hain.

Rehabilitation ka record shameful hai. Kayi studies show — displaced tribals ki 2nd generation aur poor ho jaati hai. Cash compensation forest livelihood ka replacement nahi kar sakta. Cultural rupture ka koi compensation nahi hota.

"Development" ki definition top-down hai. Highway, dam, factory — yeh "development" hai state ke liye. Tribal ke liye jal-jangal-zameen hi development ka source hai. Definitions clash karti hain.

Environmental clearance dilution. EIA Notification 2006 aur subsequent amendments — public consultation weaken hui hai. Category B projects mein tribal areas ka safeguard kam.

Compensatory Afforestation ka joke. CAMPA funds — forest divert karo, kahin aur plantation karo. Lekin plantation kabhi original biodiversity ya tribal habitat replace nahi karta. Aur plantation land bhi frequently doosri tribal areas se aati hai.

Xaxa Committee (2014) ka verdict: Virginius Xaxa report ne clearly kaha — "Displacement is the single biggest violation of tribal rights in post-independence India." Committee ne recommend kiya — blanket presumption against displacement in Scheduled Areas, land bank of tribal lands, cultural impact assessment (not just EIA), community-level rehabilitation (not individual). Implementation? Nil.

Yeh sirf legal problem nahi hai — philosophical problem hai. Indian state ne "eminent domain" ka colonial concept retain kiya — matlab state supreme, individual/community rights subordinate. Tribal worldview mein land = ancestor, spirit, identity. Cash compensation is a category error.

Jab tak "eminent domain" ki jagah "tribal sovereignty over habitat" ka principle nahi aata, yeh paradox chalega.

Theme 3: Assimilation vs Autonomy Debate

"Tribal ko mainstream lana hai, ya tribal ko tribal rehne dena hai?"

Yeh debate 1940s se chal raha hai. Do fundamental camps the.

Camp 1: Verrier Elwin — "Isolationist" (protective isolation). British-turned-Indian anthropologist, NEFA (now Arunachal) mein deeply worked. Argument: tribals ki apni civilization hai. Nehru ka "Panchsheel" — The Middle Path

Nehru ne Elwin se influenced hoke, but statecraft demands ko dekh ke, ek middle path banaya. Tribal Panchsheel (from foreword to Elwin's book A Philosophy for NEFA, 1957):

Baad Mein Kya Hua?

1970s-80s tak Panchsheel dilute hoti gayi. Development imperative (Green Revolution, steel plants, dams needed land + resources), national integration anxiety (NE mein insurgency), missionary activity aur conversion debates, aur tribal middle class jo khud mainstream access chahta tha — sab factors the. Result: gradually assimilationist tilt.

Modern Scenario — Kya Assimilation Ho Rahi Hai Subtly?

Yeh sabse interesting angle hai. Aaj koi openly nahi kehta "hum assimilate kar rahe hain." Lekin policy design mein assimilationist elements chhupe hain.

"Adi Karmayogi" naming. "Karmayogi" — Bhagavad Gita ka concept. Universally Indian philosophical framework. Lekin tribal cosmologies (Sarna, Donyi-Polo, animist traditions) mein Karmayogi ka concept nahi hai. Naming hi mainstream framework impose karti hai.

PM-JANMAN ka "development" package. Pucca ghar, road, electricity, mobile connectivity — yeh universal modernization template hai. Kya PVTG communities se poocha gaya ki unke liye "development" kya matlab hai? Onge, Sentinelese, Jarawa jaise groups ke liye mobile tower "development" hai ya threat?

Hostels & schools. Ashram schools, Eklavya Model Residential Schools — yeh accessibility deti hain but tribal children ko native environment se remove karti hain. NCERT curriculum tribal languages/histories minimally represent karta hai.

Uniform Civil Code discourse. Tribals ke customary laws — inheritance, marriage — Hindu law se different hain. UCC discourse mein tribal exemption ka status ambiguous hai.

"Adivasi" vs "Vanvasi" nomenclature debate. Adivasi = "original inhabitant" — indigenous identity, autonomy claim. Vanvasi = "forest dweller" — descriptive, no indigeneity claim. Yeh naam ki ladai actually philosophical war hai — indigenous identity ki recognition versus mainstream cultural embrace.

Autonomy Ke Liye Contemporary Voices

  • Sixth Schedule extension demands — Ladakh, Manipur hills, some Jharkhand demands

Modern policy ka blind spot — hum "development" ko single-track maante hain. Real autonomy = multiple development pathways acceptable manna.
